Terms of Service
These Terms of Service (“Terms”) govern your participation in the GWC Health Pilot (the “Pilot”) and your use of gwcadvisory.ai and the participant portal operated by GWC Advisory LLC (“GWC Advisory,” “we,” or “us”). By creating an account or connecting a wearable device, you agree to these Terms.
1. Eligibility
The Pilot is offered by invitation to adults 18 years of age or older who have received a participant access code from GWC Advisory. You agree to provide accurate information and to keep your account credentials confidential.
2. The Service
The Pilot lets you connect supported wearable and health devices (such as WHOOP, Withings, and Oura) so that your physiological readings can be collected, displayed, and used to deliver reminders and reports. You authorize each device connection through the device maker’s own secure login; we never ask for your device-account password.
3. Not Medical Advice
The Pilot is for informational and wellness monitoring purposes only and does not provide medical advice, diagnosis, or treatment. It is not a substitute for professional medical care. Always consult a qualified healthcare provider with questions about your health, and seek immediate care in an emergency. Do not disregard or delay professional medical advice because of information provided through the Pilot.
4. Your Responsibilities
You agree to use the Pilot only for its intended purpose, to provide accurate profile information, and not to attempt to access another participant’s account or data, disrupt the service, or use it unlawfully. You are responsible for maintaining the security of the device accounts you connect.
5. Data & Privacy
Information you provide and the readings collected from your connected devices are handled as described in our Privacy Policy, which is incorporated into these Terms. You may disconnect a device or request deletion of your data at any time by contacting us.
6. Consent to Communications
If you opt in, you consent to receive transactional health-reminder messages by email and/or SMS as described in the Privacy Policy. Message and data rates may apply to SMS; reply STOP to opt out or HELP for help at any time.
7. Wearable Providers
WHOOP, Withings, Oura, and other device makers are independent third parties. Your use of their devices and accounts is governed by their own terms and privacy policies. We are not responsible for the accuracy, availability, or practices of third-party devices or services.
8. Disclaimers
The Pilot is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. We do not warrant the accuracy or completeness of any readings or reports.
9. Limitation of Liability
To the fullest extent permitted by law, GWC Advisory and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or reliance on the Pilot.
10. Termination
You may stop participating at any time by disconnecting your devices and asking us to close your account. We may suspend or end the Pilot, or a participant’s access, at our discretion, including at the conclusion of the Pilot program.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above, and continued participation after changes take effect constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules.
